1. Nature of the Service

FilmPhotography.com operates a classifieds bulletin board where registered users may post listings to buy, sell, or trade photographic film equipment and related goods. FilmPhotography.com is not a marketplace, escrow service, auction house, consignment agent, or payment processor. FilmPhotography.com does not take title to any item, does not facilitate payment, and is not a party to any transaction between users.

2. No Verification

FilmPhotography.com does not verify the identity of users, the accuracy of listings, the authenticity, condition, ownership, legality, or fitness for any purpose of any item listed, or the ability of any user to complete a transaction. You are solely responsible for conducting your own due diligence before buying, selling, or trading.

3. Transactions Are Between Users

All transactions are strictly between the users involved. Users negotiate, agree on payment, arrange shipping, and resolve disputes directly with each other. FilmPhotography.com has no obligation to mediate, investigate, or resolve any dispute, and has no liability for any loss, damage, fraud, misrepresentation, non-delivery, defective goods, stolen goods, or any other outcome arising from or relating to a user-to-user transaction.

4. Assumption of Risk

You use the service and transact with other users entirely at your own risk. You acknowledge that online transactions between strangers carry inherent risks including but not limited to fraud, misrepresentation, defective or counterfeit goods, non-delivery, and identity theft. You agree that FilmPhotography.com, its owners, operators, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the service or any transaction conducted through the service.

5. Prohibited Listings and Conduct

You may not list, offer, or request:

Stolen, counterfeit, or unlawfully obtained goods;
Items you do not own or are not authorized to sell;
Items whose sale, possession, or transfer is restricted or prohibited by applicable law, including certain darkroom chemistry, hazardous materials, and controlled substances;
Non-photographic items;
Firearms, weapons, drugs, adult content, or any other item unrelated to film photography.

You may not harass, defraud, or impersonate other users; scrape, spam, or misuse contact information; post malware, phishing links, or off-site payment schemes; or attempt to circumvent site security.

6. User Content and License

You retain ownership of the text and images you submit. By posting, you represent that you own or have the right to use the content, and you grant FilmPhotography.com a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the service. You are solely responsible for the legality and accuracy of what you post.

7. Moderation and Removal

FilmPhotography.com may remove any listing or account, at any time, for any reason or no reason, without notice. FilmPhotography.com is not obligated to monitor content but may do so.

8. No Warranty

The service is provided “as is” and “as available,” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

9. Indemnification

You agree to indemnify and hold harmless FilmPhotography.com, its owners, operators, agents, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising from your use of the service, your listings, your transactions with other users, or your breach of these Terms.

10. Changes

These Terms may be updated from time to time. Continued use of the service after changes are posted constitutes acceptance. The current version is identified above.

Plain-English summary: This is a bulletin board for film photographers. We don’t vet users, we don’t handle your money, and we’re not responsible if something goes wrong. Deal only with people you feel comfortable with, inspect before you pay when possible, and use payment methods that offer buyer protection when you can’t.
